BBQ Guys Customer Service Chat can record, use, and retain your information provided, as well as the communications within the chat, for purposes of assisting you during the conversation, provide related support for your services, to improve our products and Services, and marketing purposes. If you do not consent, please do not use the chat assistance feature.

      • Photos and Videos. We allow you to post photos and videos on the Services or to submit them to us as described in the chart above. Applicable laws and regulations may vary with respect to whether such materials are considered to be biometric information. For clarity, BBQ Guys does not create a record of facial geometry from your photos or videos and does not use your photos or videos for the purposes of facial recognition, facial surveillance, or otherwise as a biometric identifier. When you interact with these third party platforms through the Services, we will receive information about you from the third party platform service and you will be choosing to share information about your interactions with BBQ Guys with that social media service.

        In addition, the third party platform service may set their own cookies and collect information about your use of the Services, including your IP address or other device identifiers, and which pages you visit on the Services. These third party platforms may be able to collect certain information on your visits to the Services regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third party platform. If you are logged out or do not have an account and visit a page with a social plug-in, your browser sends a more limited set of information. Like other sites, the third party platform will receive information about the webpage you are visiting, the date and time of your visit, and other browser-related information. They may use that information to help them improve their products or for other purposes set forth in their privacy policy. We may also receive information about you if other users of social media give us access to their profiles and you are one of their connections or friends.

        The information we collect is subject to this Privacy Policy. The information collected and stored by the third party remains subject to the third party's privacy practices, including, without limitation, whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but may retain the information previously collected.

        If you choose to post information to a third-party platform, that information may be public.

      8. Third Parties who acquire the information in connection with a Business Transition
        In the event BBQ Guys goes through a business transition, BBQ Guys reserves the right to disclose and transfer all personal information related to the Services (including, without limitation, during the course of any due diligence process): (i) to a subsequent owner, co-owner or operator of the Services; or (ii) in connection with a corporate merger, consolidation, restructuring, bankruptcy, the sale of certain of BBQ Guys' ownership interests, assets, or both, or other company change. By providing your information, you understand and agree that we may transfer such information to the acquiring entity without your further consent, except where required by law.

      9. Non-Personal Data
        We may share non-personal information, such as certain Device ID/Interaction Information, hashed or otherwise de-identified or pseudonymized data, and aggregated user statistics, with third parties in our discretion and as permitted by law, including for targeted advertising purposes.

  3. Third Party Advertising and Analytics/Privacy Controls/Do-Not-Track

    BBQ Guys works with third party business partners, including online advertising companies, ad agencies, and analytics providers to serve BBQ Guys ads online, and to provide us with information regarding the use of the Services and the effectiveness of our advertisements. These third parties may set and access their own tracking technologies (like cookies and pixel tags) on your device, and they may otherwise collect or have access to Device ID/Interaction Information and other information about you, some of which may be personal data or personal information under various state laws. Some of these parties may collect personal data over time when you visit the Services or other online websites and services. We may share information, typically information that has been aggregated or de-identified, pseudonymized, Device ID/Interaction Information, and non-precise location information with third party advertising companies, analytics providers, and other third parties, including for the purpose of serving you more relevant ads on and off the Services.

    If you would like to opt-out of third party advertising and analytics, there are a variety of tools available to you:

    • Cookie Opt-Out Tools - To disable sharing through cookies set on our site by third parties for advertising and analytics purposes, please adjust your cookie settings using the Manage My Cookies link in our website footer. Please see the Jurisdiction-Specific Rights Section below for additional rights individuals in certain jurisdictions may have.

    • GPC - Global Privacy Controls (GPC) offered by some web browsers are settings that automatically inform websites of your privacy preferences with regard to third party online tracking including exercising your rights and requesting the web application to disable tracking you for certain purposes. When you choose to turn on the GPC setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and/or other web services you encounter while browsing to exercise your privacy rights and stop tracking your activity for certain purposes.     • NAI/DAA Opt-Out - Some of the companies we use may be members of the Network Advertising Initiative (NAI) or Digital Advertising Alliance (DAA). The NAI provides information regarding targeted advertising and the opt-out procedures of NAI members, including opt-out mechanisms for web browsers, mobile and other connected devices, and a tool to opt out from participating NAI members using your hashed email address for interest-based advertising. You may also want to visit the DAA's website, which provides information regarding targeted advertising and offers an opt-out for DAA-participating companies.

    • Mobile Device - Mobile devices may contain settings that allow you to disable tracking advertising and/or analytics.

    • Google Analytics/Adobe Analytics - We use Google Analytics and Adobe Analytics, which use cookies and similar technologies to collect and analyze information about the use of the Services and report on activities and trends. These services may also collect information about the use of other websites, apps, and online services.     Please note that opting out through these mechanisms does not opt you out of being served advertising, and that you will continue to receive generic ads while online. Your opt-out choices are typically browser and device specific; if you disable your cookies, upgrade your browser after opting out or if you use multiple different devices, please opt-out on each device and each browser separately.

  4. Loyalty Program Disclosures

    We provide the BBQ Guys Rewards Program which provides you with loyalty benefits such as points on your eligible purchases that are redeemable for credit, the ability to maintain wish lists and your order history. This program is subject to termination at any time at our sole discretion. Additional information available at www.bbqguys.com/rewards.

    Through our BBQ Guys Rewards program, we process: username, password, security question for your account, and wish lists. We do not sell or process that data for targeted advertising purposes. For information regarding how we process all other categories of data please review the “Personal, Sensitive and Non-Personal Information We Collect and How We Use and Disclose It” section of this Privacy Policy.

    Impact of Deletion of Personal Data: If you are a BBQ Guys Rewards member who is eligible to and chooses to exercise your right to delete your personal data, your BBQ Guys Rewards account, including the unique membership identification number, any accrued points associated with the account, your contact information, and any other information tied to your membership account will also be deleted. There is no benefit of the BBQ Guys Rewards program that can be extended to you after the deletion of your personal data.

    • Our program is based on points which accrue to your unique membership identification number based on your purchases. Points are debited based on your point redemptions and returns. Without the ability to relate and track your transactions to the membership identification number that will be deleted as a result of your deletion request, we will be unable to add or deduct points based on your transaction activity or access any previously accrued points.

    • Once your unique membership identification number is deleted from our systems, we will be unable to recognize your membership identification number to provide you with access to your order history, wish lists, and other member-only benefits that we may offer from time to time.

    If you choose to exercise your data privacy rights such that your membership in the BBQ Guys Reward Program is impacted, we will notify you at the contact information you have provided to us, the consequences of your decision at least five (5) days prior to discontinuing your membership or benefits.

  5. Your Choices

    We may provide you with the option to update your information through the settings under your account. In addition, you may opt-out of marketing communications as set forth below. If you are a resident of certain jurisdictions, you may also have the right to make choices about how we collect, use, and share or sell your personal information.     • Email. You may unsubscribe from marketing emails we send you through the opt-out mechanism included in each such email. Note, however, that we reserve the right to send you certain communications relating to your use of the Services, notices of changes to this Privacy Policy or other terms, or similar administrative and transactional messages.

    • Text Messages. If you sign up to receive SMS, MMS, or RCS messages from one or more of our Services, you may unsubscribe by replying STOP to the short code.

    • Direct Mail. If you would like to stop receiving BBQ Guys mailings, please email us at privacy@bbqguys.com.

  6. Security

    BBQ Guys takes commercially reasonable steps designed to secure your personal data; however no data transmission over the Internet, wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. BBQ Guys cannot ensure or warrant the security of any information we collect. You use the Services and provide us with your information at your own risk.

  7. Third Party Content and Links

    The Services may contain content that is served by someone else or links to third-party content, applications, or websites. BBQ Guys does not control this content or these sites. The third-party operators and content providers use their own cookies or other tracking technologies, and they may independently collect information from or about you. BBQ Guys is not responsible for the privacy practices employed by any third party.

  8. Consent to Transfer

    BBQ Guys is based in the United States. Please be aware that your connection will be through and to servers located in the U.S. and other countries. By using the Services or providing us with any information, you fully understand and unambiguously consent to this transfer to, and processing, usage, sharing and storage of your information in the United States and in other jurisdictions, for which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to the laws in those jurisdictions. Your information will also be disclosed to third parties as described in the “Personal, Sensitive and Non-Personal Information We Collect and How We Use and Disclose It” section above.

  9. General Audience Site

    The Services are not intended for use by individuals younger than 18. We do not knowingly collect personal data from individuals younger than the age of 18.

  10. Changes to this Privacy Policy

    We reserve the right to change this Privacy Policy at any time. If we make material changes to our privacy policy, we will update the effective date and post a notice on the Services. We may also provide notice to you in other ways, such as through contact information you have provided, and provide you with the ability to opt-in or opt-out of the changes as required by law.       Access Your Information/Obtain Your Information/Data Portability (CO, CT, DE, IA, MT, NE, NH, NJ, OR, TX, UT, VA Residents) You have the right to confirm whether we are processing your personal data and request to access such data, obtain a copy of the personal data we hold about you and, to the extent feasible and where permitted by applicable law, in a readily usable format to allow data portability. For Oregon residents, and where otherwise provided by applicable law, this includes a list of third parties with whom we have shared personal information. For Delaware residents, and where otherwise provided by applicable law, you have the right to request a list of the categories of third parties with whom we have specifically shared your personal data.

      Correct Your Information (CO, CT, DE, MT, NE, NH, NJ OR, TX, VA Residents) - You have the Right to correct the personal data we hold about you.

      Opt-Out of Sales of Your Personal Data and Targeted Advertising (CO, CT, DE, IA, MT, NE, NH, NJ, OR, TX, VA, and UT Residents) – You have the right to opt out of the sale of your data. BBQ Guys does not sell personal data to third parties for monetary compensation, as defined by Iowa, Utah, and Virginia laws and therefore does not offer this opt-out right to residents of these states. Sharing of IP addresses or mobile ad IDs with third party advertising vendors and certain other targeted advertising practices may constitute a “sale” under definitions set forth under other state laws. Please note that opting out of sales and targeted advertising will not opt you out of all advertising.       A Note About Cookie Based Opt Outs for Sale and Targeted Advertising

      BBQ Guys engages in online advertising practices (and certain analytics or similar activities), that may be considered a “sale” in CO, CT, DE, MT, NE, NH, NJ, OR, and TX and/or “targeted advertising” under each of these states’ laws. You may opt out of cookies set by third parties that may be considered sales and targeted advertising by adjusting your cookie settings using the Manage My Cookies link in the website footer.       Opt-Out of Profiling in furtherance of legal or similarly significant effects - BBQ Guys does not process your personal data for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects as defined under applicable laws.

      Right to Appeal (CO, CT, DE, IA, MT, NE, NH, NJ, OR, TX, and VA Residents) - If you are a resident of Colorado, Connecticut, Delaware, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, or Virginia, and you would like to appeal our decision relating to your request, you have the right to submit an appeal and can do so using the methods to exercise your rights listed immediately below. Please include your full name, the basis for your appeal, and any additional information to consider.

      Authorized Agents Submitting Opt-Out Requests for Sales and Targeted Advertising (CO, CT, DE, MT, NE, NH, NJ, OR, and TX Residents Only) - If you are an authorized agent submitting a request to opt out of sales or targeted advertising on behalf of a Colorado, Connecticut, Delaware, Montana, Nebraska, New Hampshire, New Jersey, Oregon, or Texas resident, please submit the request pursuant to the above instructions. We may require documentation to authenticate the Consumer's identity and that you are authorized to submit the request on the consumer's behalf in order to be able to fulfill your request. Please keep in mind that if we cannot authenticate that you are authorized to act on the Consumer's behalf or we cannot authenticate the Consumer's identity, we may deny the request.

      Sensitive Data - If you are a Colorado, Connecticut, Delaware, Nebraska, New Hampshire, New Jersey, Oregon, Texas, or Virginia resident, we will obtain your consent to the processing of any Sensitive Data (as defined by the applicable state law) we collect. You may also opt out using the methods to exercise your rights listed in this section. If you are an Iowa or Utah resident, you have the right to opt-out of the processing of Sensitive Data, each as defined by the respective privacy law, to the extent BBQ Guys processes any such data.

    2. Nevada

      If you are a Nevada resident, please note that we do not sell your personal data (or covered information) as defined in Nevada S.B. 220. However, if you are a Nevada resident, you may still submit an opt-out request, and if our practices were to change in the future, we would honor your request. Your request to opt out of the sale of your covered information must be submitted to BBQ Guys, Attn: Legal Department, 8151 Airline Hwy, Baton Rouge, LA 70815. Your request must include your full name, street address, city, state, zip code, and a valid email address so that we can contact you if needed regarding your request. If you previously provided a phone number, including it will assist us in making sure we identify you as someone who wants to opt out. You may be required to take reasonable steps as we determine from time to time to verify your identity and/or the authenticity of your request.

    We make reasonable efforts to notify you of the purposes for which personal information will be used or disclosed and if the initial purpose changes.
